These Terms of Service (“Terms”) govern your access to and use of the website, storefront, and services of SKS Signature Designs, LLC (“we,” “us,” or “our”). By visiting our site or purchasing from us, you agree to these Terms. If you do not agree, do not use the Services.

1) Overview
We sell made‑to‑order products produced and shipped by our own facilities and/or trusted production partners. Additional policies apply and are incorporated by reference:

2) Eligibility & Your Account
You must be at least the age of majority in your jurisdiction to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3) Orders, Pricing & Availability
- Order acceptance: Your order is an offer; we may accept or decline it after review (e.g., due to suspected fraud, availability, or pricing/description errors).
- Made to order: Most items are produced after you purchase; see our Shipping Policy for processing and transit times.
- Pricing & taxes: Prices are listed in your selected currency (where supported) and exclude applicable taxes and shipping unless stated. Taxes are calculated at checkout based on your shipping address.
- Promotions & coupons: We may offer limited‑time promotions subject to additional terms; promotions may be changed or withdrawn at any time.
- Availability: Certain products or variants may be unavailable or delayed. We reserve the right to limit quantities per order, household, or account.
4) Payment
You authorize us and our payment processors to charge your selected payment method for all amounts due, including taxes and shipping. If your payment method fails, we may cancel or suspend your order until payment is resolved.
5) Shipping & Delivery
Shipping methods, rates, and estimated timelines are described in our Shipping Policy. Delivery estimates are not guarantees. Title and risk of loss pass to you upon delivery to the carrier. For split shipments or items fulfilled by multiple partners, items may arrive separately.
6) Returns, Replacements & Refunds
Because products are made to order, we generally do not accept returns for buyer’s remorse (e.g., size/color preference). If your item is damaged, defective, misprinted, or incorrect, contact us within the window stated in our Returns & Refunds Policy and we will replace or refund according to that policy.
7) Product Descriptions; Colors & Sizing
We try to be accurate, but errors may occur. Colors can appear differently due to display settings and printing variations. Please check the size charts on product pages. Minor variations in color or placement may occur in on‑demand production and are not defects.
8) Acceptable Use
You agree not to misuse the Services. Prohibited actions include: violating laws or third‑party rights; attempting to gain unauthorized access to systems; interfering with site operation; scraping or reverse‑engineering; or using the Services to transmit malware, spam, or illegal content.
9) User Content (Reviews, Comments, Submissions)
If you submit content (e.g., reviews, photos), you grant us a non‑exclusive, worldwide, royalty‑free license to use, reproduce, modify, publish, and display that content to operate and promote the Services. You represent that you own or have the rights to the content you submit and that it does not violate any law or third‑party rights.
10) Third‑Party Services
Our Services integrate with third parties (e.g., Shopify for ecommerce, payment processors, Printify and production partners for fulfillment). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third‑party sites or services.
11) Intellectual Property
All content on the site—including logos, graphics, product images, text, and layout—is our property or used with permission and is protected by applicable laws. You may not copy, distribute, or create derivative works without our written consent.
12) Disclaimers
THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. Some jurisdictions do not allow exclusions of implied warranties; some limitations may not apply to you.
13) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE (AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, PARTNERS, AND SUPPLIERS) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT AT ISSUE.
14) Indemnification
You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Services.
15) Governing Law & Disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction of state and federal courts located in Oldham County / La Grange, Kentucky for any dispute arising from or related to the Services or these Terms, except where prohibited by law.
16) Changes to the Services and to These Terms
We may update the Services and these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
